McMahon's RV Deceptive Trade Practices

I am writing to inform you about the conduct of McMahon’s RV. I purchased a new RV (August 15, 2011) from McMahon’s and financed the purchase with Bank of the West. I traded in a 2006 Winnebago Aspect that was financed with Ally (formerly GMAC). As part of the transaction, when the loan on the new RV funded, the trade-in was to be paid off.
This loan funded on August 16th, 2011. I believed that Bank of the West would pay off the trade-in, but I now understand that all the funds went to McMahon’s. McMahon’s was supposed to pay off the balance on the trade-in owed to Ally, but now, two months later, it has not done so. Since then, McMahon’s has repeatedly made numerous false claims, starting with VP and Finance Manager telling me that it was just an error at their HQ in Irvine. They said they would meet with Brent McMahon and figure out what the problem was. Then the excuses progressed to the check was cut and they were waiting for Mr. McMahon to sign it (this was about three weeks ago). Ally got involved and VP assured them, starting a week ago, that the check had been sent. It didn’t arrive, and he even gave them a check number for the check which never arrived. It has now been two months since McMahon’s received the funds from Bank of the West. Over $30,000 of those funds that McMahon’s kept do not belong to them and should have been paid to Ally.
Also, I paid $4,206 for an extended warranty that was never provided to me. I asked in writing for a full refund of that within a few weeks of that purchase, to no avail.
It could be that McMahon’s will never pay this money, and is committing theft. However, even if they pay it soon, it is apparent that at best McMahon’s is wrongfully using “the float” by substantially delaying the payment of my trade-in. In the meantime, my credit suffers, because I became delinquent on the loan with Ally (believing that it was paid in August).
I did business with McMahon’s after checking their rating with the Better Business Bureau and seeing that they had an A+ rating. After having this problem with them, I have done more research and have seen that there have been many more complaints on these two specific areas: failure to pay off trade-ins and failure to provide the warranty purchased.
Whether these issues are eventually resolved, this company should not be allowed to keep it’s A+ rating because it looks like McMahon’s is engaged in a pattern of using customers’ money as long as they can, to the detriment of the customer. This conduct of repeatedly failing to pay off trade-ins is deceptive and fraudulent, and for this reason I thought you should be advised.
The Better Business Bureau is a great program, and I appreciate that there is a forum to air complaints with a business and get information about a company. However, it seems that McMahon’s knows how to maintain its rating without changing its practices, by answering complaints with the same excuses. Businesses should not be able to manipulate the Better Business Bureau. Consumers who rely on the Better Business Bureau are being misled and repeatedly damaged by doing business with McMahon’s. McMahon’s emphasizes its high rating with the Better Business Bureau in its advertising. They should not be able to use the good name and reputation of the Better Business Bureau. With all due respect, it seems that the Better Business Bureau is being unwittingly used to help perpetuate McMahon’s fraudulent activity.
I have never filed a complaint with the Better Business Bureau on any business. I need help with this company. I need them to pay off my trade-in, refund my money for the warranty I was never provided, and repair my credit score.

The Better Business Bureau really doesn't have any teeth. You need to contact the DMV Occupational Licensing office in the region you bought the coach. The dealer has posted a bond to help ensure they operate ethically, and do not unreasonably hold funds. The DMV is the agency with power in this case.Posted 10-27-2011 at 11:30 AM by Automobilist

Hi "Robbed" and everyone else here... I'm new to the forums and I'm looking for some help here.
I purchased a 2011 Attitude Toy hauler By Eclipse at one of Mcmahon's RV shows at Angels Stadium in Anaheim. I took delivery of it at the Colton store. This was on Nov. 22, 2011.... I traded in my 2005 Forest River fifth wheel toy hauler that had an outstanding balance left on it through my Credit Union.... Today is Dec. 15th, and they have yet to pay off my trade in.
California State law requires dealerships to pay-off these loans within 21 days of the transaction beign completed. We are way past that.
I've been getting the run~around for several weeks now. According to the people at Colton, all of the pay-offs are handled through the Irvine HQ dealership. I contacted a person over there named "Coleen" Her story was that, the check has been cut, but Brent McMahon has yet to sign it. Yeah right...
After not getting anywhere over the phone, I paid them a visit in person... I was given some story by the receptionist that Coleen was in a "Meeting" So, naturally, I waited for her... I told the receptionist that I had nothing but time and that I would gladly wait for Coleen to see me....
After several hours, Coleen showed her face, and I explained to her that her business is in violation of the law and that by not paying off my trade, it was costing me money every 2 weeks as the loan payment is automatically deducted from my checking account.
Coleen cut me a check to cover the loan payment, and assured me that the matter would be taken care of "tomorrow"... Well, that was two days ago... I tried to call Coleen again today and was told that she is out of the office until Monday...
Guess where I'll be going tomorrow.
I have already contacted the DMV occupational licensing office In Irvine, and will be filing a formal complaint shortly... I called an attorney that has experience dealing with McMahons and left a message for him to call me for a consultaion.... I plan on notifying the BBB....
My question here is for the OP.... "Robbed" how long did it take for you to get your trade-in issue resolved and do you have any advice for me to help me get mine paid off...? And thirdly, can you please conact me if you are at all interested in pursuing a class action suit against this unethical company?
Any one out there that can help me?

Rob, I do not know what exactly happened to you, but we purchased our 5th wheel at the Anaheim show also. It was by far the easiest purchase that we have had with McMahon's. This was actually our 3rd purchase from them and we have never had a problem. We did have an issue with our previous coach. We purchased a 2007 Monaco Monarch and shortly there after, Monaco filed for bankruptcy. We had a service center that we used for years, but then they kept telling us that the factory warranty was no longer valid because Monaco filed. We contacted Joe G. at the Irvine service center and confirmed the same information, but Joe was willing to look at several issues for free and actually resolved 90% of the issues at no cost to us. He even refered us to the finance department and they were able to get us an extended warranty, that for a minimal fee, acted like a factory warranty, covering the remaining issues with my coach. That was the unit we traded in on our new Brookstone. I guess my only question to you, did it get resolved? McMahon's has always been there for me and I know that they always will be... I know if they caused you any grief, they will do whatever they can to rectify the problem.

My Husband and I had a very similar experience with Mc Mahon's back in 2008...seems they haven't changed their practices yet! We purchased a used Beaver Patriot from them and wrote a check to McMaon's for the total balance of coach $215k , plus they took our trade which had a payoff and they were to pay it off...which of course they did not right away. My story is the same as Robbed, they kept telling me the check was mailed but of course it never came. We contacted our lender and sent them proof of trade so they did not report the non payments to the credit breau. But after two months they told us we would have to make the payments until Mc Mahons paid it off. We did, but continued to pursue McMahon's for the pay off. I called the DMV and reported to them what was going on and they got involved, so after 6 months of fighting with them they finally paid it off. My husband was so mad by this time he told them we would be showing up at every RV show they had , as well as at the front gate of their store location with signs telling people not to shop there, that they should beware. Paul at the time was the GM, and he was a very good liar, as well as the gal in the finance department. As for Brett...well he is the BIGGEST LIAR of them all....he never once would return a phone call to us in 6 months, but what I remember when we purchased our coach that he sat in it with us and handed us his card and told us "Call me if you ever have a problem" HA...HA! What a joke.... It also took them over one year to complete our "Due Slip" on the purchase of the coach.
I am in on anything you would put together against these guys as I do believe that they are breaking the law by "floating" your cash on payoffs to run there business. A Class action suit would be awesome, as we have had nurmerous issues with our coach as well, but would atest to what they did to us, and I have all the paperwork to back it up! Hello, A thought for consideration. Are any of you people who have complaints members fo Good Sam Club? Perhaps it can help with getting your accoounts settled. But the best part is that hundreds of thousands of members read about your problems and I can imagine the reaction. I had just sent them a note inquiring about a rig. Guess I won't bother corresponding with them after this.
