Montana LLC

We are considering buying a new Canyon Star via a Montana LLC to save on sales tax. Anybody had experience with this?

I never tell anyone to do a search, but this time I will. If you search this topic, it's been discussed several times a year for many years. It's a controversial topic with no real definitive answer.

Be a good citizen, pay the tax if that is what your state requires, or you could move to a state where there is no sales tax.

Yes, there's a ton of threads on the Montana LLC's, I agree with the above advice. I read many horror stories on this forum and others about having to pay back taxes and worse when the state and locality the vehicle was "principally garaged" in found out.

I have s&b in Texas, Montana, and Florida. When purchasing my RV I researched heavily where to title. I was legally able to title in Montana without an LLC, but ended up titling in Texas. Primary reason was my insurance for replacement value required a garage for the RV, and that only existed in Texas.

Only legal if it's legal for you. If you have a residence and keep the rig there you will be required to register it there.

We own property in Montana and I looked into it. The annual license fees on a new motor home can be pretty stiff. An $800 luxury tax is charged by the state on motorhomes with an original MSRP at or above $300,000. Note the "MSRP."

As for the LLC legality, that's not the issue. If Montana is not your official state of residence (domicile), the laws of the state where you are domiciled will govern who collects the sales tax, and the amount. A LLC will not protect you from that.

I couldn’t agree more. If you live in Montana fine. If you live in another state pay the taxes. You are paying for the services of the state you live in.

We did this back in 2014 when we bought our new DS. It worked out great. We save a considerable amount of money. But, I felt like it was perfectly justified since we had sold our home and were fulltiming at the time and no state could claim we lived in their state.

This time around, we won’t do it since we have a residence in Nevada.

I would say it depends on your circumstances as to whether or not it’s a good idea. If you own a residence in a particular state and you bring your MH to that state, I think you would be hard pressed to justify not paying that state’s sales taxes and registration fees. IMHO.

This is the best advice concerning a Montana LLC. If u are financing your coach it will be very difficult to do with a Montana LLC. Regarding insurance, there are a few companies that will write a policy at a fair price.

Some states require the vehicle to remain out of state for a stipulated period of time and limit the length of time the coach may be in your home state.

A whole lot of people do this'd whether it is legal or not is between you and the State you live in. My previous coach was owned by a guy in Illinois and he had his coach registered in Montana and the Illinois come after him for tax evasion, He kept good records and could prove the coach had never been in the state and was able to win the suit. This is just one case and theres a bunch of coaches registered on Montana. Just understand what the risk is and and you can then make an educated decision.
