The " in gear "portion, even both problems , may be related to a defective , daytime running light module.
The module is set up to feed low voltage to the high beams, when in gear, and not turn on the high beam indicator while doing so, so internal problems may be at fault.

Problems like this are often traced back to a bad ground somewhere, in this case, if your lights are not as bright as should be, that may be another indicator. If you have a bad ground, voltage will travel where it can to find a ground, even if it is through the high beam indicator to a dash ground.
One way to isolate the problem to a defective , DRL module , would be to locate the module or the day time running light fuse, and disconnect it.
Sorry , I can't offer any info on location, of the module or the fuse.
