Eligibility Requirements
Workhorse Custom Chassis, LLC ("Workhorse") is sponsoring the 2005 "Texas Motor Speedway weekend with Workhorse" Promotion (the "Promotion"). The promotion is open to all consumers ages 21and older with a valid drivers license ("Participant"). The promotion is void where prohibited.
Agreement to Official Rules
Participation in the Promotion by a participant constitutes full and unconditional agreement to and acceptance of these Official Rules, as may be amended from time to time by Workhorse in its sole discretion. Any modification of these Official Rules shall be communicated to participants by any reasonable method of communication.
Timing
The promotion Period ("Promotion Period") begins January 17, 2005 and ends at noon Eastern Standard Time, March 15, 2005.
Participation
Participants may enter the Promotion by submitting their name, address, phone number and email address at
www.workhorse.com on the designated promotion page. Alternatively, participants may enter by writing their name, address and phone number and email address on a 3-inch by 5-inch index card and mailing it to TaigMarks Inc., 223 S. Main St., Ste. 100, Elkhart, IN 46516. All Entry Forms must be received at the drawing location by noon Eastern Standard Time on March 15, 2005 in order to be eligible for the drawing. All Official Entry Forms received after noon Eastern Standard Time on March 15, 2005 will be ineligible to win a Prize. The drawing for awarding the Prize(s) will be conducted on March 15, 2005. All Entry Forms must be verified as being complete and correct to be eligible for the Promotion. All incomplete Entry Forms or Entry Forms which are not verified as complete and correct by Workhorse shall be ineligible for the Promotion. All eligibility requirements must be met on or before the Drawing Date in order to be eligible for the Promotion. Workhorse is not responsible for lost, late, illegible postage due or misdirected mail or entries. All materials submitted become the property of Workhorse and will not be returned.
Prizes
A "Prize" is a four (4) consecutive day, three (3) night stay at Texas Motor Speedway and includes an RV camping site in the Reserved Workhorse VIP Camping area and two premium grandstand tickets for the NASCAR Winston Cup Race and Busch Grand Nationals race and Workhorse apparel. Winner is responsible for all other expenses incurred as a result of the racing weekend, including getting to and from Texas Motor Speedway, gasoline, meals, camping supplies, etc.
If the eligible Participant who is the potential Prize winner cannot be contacted within two (2) days after the first attempt to contact such potential Prize winner, an alternate participant may be selected in his or her place at random from all eligible entries and the initial eligible Participant who could not be located will not be entitled to receive a Prize. No cash or substitution is permitted, except by Workhorse, who reserves the right to substitute a prize or premium of comparable value is the Prize cannot be awarded as described for any reason. The potential odds of an Eligible Customer winning a Prize depend on the number of entries.
Except where prohibited, liability of federal, state or other taxes, fees, freight charges and other charges associated with receipt of any Prize, is the responsibility of the Prize winner, not Workhorse, Grand Vehicle Works Holdings, LLC or Union City Body Holding Company, LLC. The award of Prizes may be reported to the appropriate taxing authorities. Each winner by acceptance of a Prize represents that he or she has complied with all rules, and releases Workhorse and its respective parents, subsidiaries, affiliates, officers, directors, managers, employees, agents and representatives from any and all liability for injuries or damages sustained in connection with the use, acceptance or awarding of any Prize.
Verification
Within twenty (20) days of being notified that he or she has been selected, the potential Prize winner will be required to sign and return an affidavit of eligibility and a release of liability/publicity, except where prohibited. Failure to sign and return the affidavit and release within the time required constitutes waiver of the Prize, and the Prize will be awarded to an alternate winner. Except where prohibited by law, participation in he Promotion constitutes the Prize winner's consent to Workhorse's use of the winner's name, city and state, likeness, photograph, statements made by the winner about the Promotion, Workhorse and/or Prize information for promotional purposes without further payment or consideration.
Cancellation
Workhorse may cancel, suspend, amend or revoke the Promotion at any time, in whole or in part, if, in the opinion of Workhorse, circumstances deem it necessary.
Miscellaneous
By participating in the Promotion, participants of the Promotion agree to release, hold harmless and forever discharge Workhorse, and its respective parents, affiliates, subsidiaries, officers, directors, shareholders, managers, members, employees, agents, advertising and promotional agencies and representatives (collectively, the "Indemnities") from any and all causes of action, claims, suits, expenses and liabilities of any kind, known, which participants now have or might hear hereafter have against the Indemnities arising from participation in the Promotion. Participants agree that the validity, construction and interpretation of these Official Rules shall be governed by the laws of the State of Illinois. Participants hereto irrevocably agree that all actions of the proceedings in any way, manner or respect, arising out of or from or related to the Promotion shall be litigated only in courts located in Chicago, Cook County, Illinois. Participant hereby consents and submits to personal jurisdiction in the State of Illinois and waived any right such participant may have to transfer the venue of any such action or proceeding. The Promotion may not be combined with any other promotions for compatibility.
Winners Notification
Results of the Promotion may be obtained by sending a self-addressed, stamped envelope to "Texas Motor Speedway weekend with Workhorse", TaigMarks Inc. 223 S. Main St., Ste. 100, Elkhart, IN 46516. Requests must be received by March 30, 2005.
