HELP!! Am I being ripped off?
My husband and I are buying a brand new 2016 Winner ago Vista 31BE. We love it for all the beds and bunk beds in a smaller rig. I did a lot of price shopping and was able to get a dealer 200 miles away to match a deal from a dealer far away. It's a greal deal...I think. We went up and test drove and noticed a few things wrong with it.
1. The pocket door to the bathroom wouldn't shut or line up.
2. The cabinets in the bathroom wasn't tightened together (frame was falling away from each other).
3. The bumper and side wall on the outside were torn apart and the trim piece and screws were coming out of the frame.
4. Some cosmetic stuff on the walls (dings).
5. Windshield has a hole in it from a rock and is on order.
So we gave 5000 towards the downpayment on our credit card and we're told they would do the PDI and replace windshield and have it next weekend. We get a call from service who says they are not easy fixes. The wall of the RV is off and that is why the door wont shut. They are waiting for a call from Winnebago on how to fix it. The service girl said it might have to go back to Winnebago but the sales guy said he talked to the head service guy and they know it won't have to go back and that Winnebago has a steel frame and that it must be an easy fix.
Would you buy this RV and how would I go about getting my deposit back? They don't have any other 2016s left. What should I do? Thanks for listening!!

You may be between a rock and a hard place .
When you gave the deposit , did you sign a sales agreement ?
Some states just by signing the agreement you've entered into a binding contract , there's no going back.
If you have a sales agreement , read it carefully , it should outline your legal rites , as far as cancelling the sale and getting your deposit back.

Sounds like a shady dealer. I'd get my deposit back anf find another dealer. There are lots of RVs on the lots.

If you can get your money back and buy elsewhere, that MH should have never been on the lot for sale until those items were repaired. If you are locked into the deal, then stay on top of it and call Winnebago for some assistance they might be able to give you. The repairs themselves are doable and you will most likely never know it after they are fixed. The problem will be how long they take to make the repairs needed. If this continues you may want to contact a lawyer in your area and see what your rights are. The consultation is usually free and if it were to go to litigation Winnebago and your Dealer could also be on the hook for any legal fees, should it go that far. If they know you are willing to do that, it will most likely get them to do the repairs in a timely manner. But try the nice guy approach first, if that doesn't work, ramp it up from there.

DEMAND your deposit back and walk away. What you've described is not the definition of a product that is fit for use, and therefore they have no legal basis to hold your money. Get a lawyer only if necessary, but you can always threaten to do so. They may claim "you bought it" and have only the warranty from WBGO to rely on for it to be made right. THAT is pure BS, unless you signed ALL the paperwork and drove it off their lot.
If that is the quality WBGO is sending out to the market these days, I would be looking for another brand.

Yes... it's worth it to get away from that even if you lose 5000.

I was wondering the same thing. Why leave a deposit and sign a sales agreement on something that you witnessed having things wrong with it????
Hope you are able to get your deposit back. Keep all documentation in case you need a lawyer.
But as they say, "Oh HELL NO!" There are many other rigs out there for you.

The deposit was paid after a viewing showed these issues...the contract, verbal and written is that these issues will be repaired before purchase...right?
Except for the bumper, the description of the issues are cosmetic...and the bumper could be cosmetic too.
If the issues are not fixed, the contract is void and the deposit should be returned.
It is sad, how RV's are treated between the factory door and the hands of a loving owner, but is just the way of things.
Hope that the repairs can be done and done properly.
