We are new to the forum so hope this is posted correctly. We have recently relocated from Florida to Missouri. Ready to do the registration thing but am told MO is a state where the personal property tax includes RV's and is quite high. A couple of people have suggested registering it in Montana which eliminates sales tax and personal property tax.
Has anyone had any experience with this? Pro's and Con's.
Thanks

The answer can vary from state to state. You should call an attorney in Montana familar with these issues. We used Bennett Law Offices in Missoula. Their phone number is (406) 543-5803. Talk to John there. He'll tell you if there is an advantage to setting up a Montana LLC.

Thanks for the response. I was hoping to get an attorney's name that someone had used. I appreciate the help

You should consider you new neighbors' reaction if you park an out-of-state licensed MH permently, with occassional trips, in the area, that turns out to be licensed out-ofstate in order to avoid local taxes. Several years ago this occured in WA where it resulted in triple, sales and excise taxes, penalties.....

Two things here. First of all, forming a corporation in another state and registering a vehicle to it is completely legal and should be of no concern to your neighbors or local police. Second, the issue in WA a few years ago was nothing like this. That issue was people claiming to be residents of another state when in fact they were residents of WA. Apples and oranges.

You might also want to talk to a local lawyer. At least in our case we were advised against it. Establishing a corporation to avoid taxes might be considered fraud which makes the corp invalid. Also I have heard that at least one state is starting to enforce the fuel tax law. If the unit has more than 2 axles or is over 26,000# and is owned by a corp it is considered commercial and subject to IFTA.. This is mostly second hand but worth checking out. YMMV

This was an instance of a WA resident registering a vehicle with an Oregon PO address or a relatives Oregon address, in his name in OR. Oregon has no sales tax. Washington does. This is not the same as forming a corporation in MT and that corporation owning property.
One is illegal, the other legal.
