The New York state attorney general's office conducted a lengthy investigation into 'deceptive marketing' by Verizon Wireless while promoting their "Unlimited" BroadBandAccess and NationalAccess plans.

As a result of this investigation, Verizon has agreed to a settlement that reimburses $1 Million dollars to some 13,000 customers who had their account wrongfully terminated. (The money represents the cost of equipment customers could not get refunds on, not 'early termination fees'.)

More importantly, there was this official statement made by Verizon:

Verizon Wireless has voluntarily ceased cutting off customers based on their data usage and no longer prohibits common internet uses.

With that said, its my opinion that the "5GB Limit" is no longer a threat hanging over any existing or future verizon broadbandaccess subscribers.

That's great news since I am a new Verizon air card customer. However, I wonder what "common internet uses" means? And I assume that this ruling and decision affects all 50 states, and not just NY?

I checked with the big V yesterday about this since I am one of the 13,000 users that were turned off.

The girl I talked to didn't know what I was talking about right off, but quickly went to get her supervisor who filled her in. The settlement is voluntary on Verizon's part, and will be handled nationwide.

I was very upset at Verizon when they did this, and am happy to see someone did take action against it. If they do in fact change their agreement like Sprint does, I will go back to them. The Sprint card I have now is almost as good, works well in Rev A, but is quite a bit slower in anything less, and the coverage area seems a bit more limited.

My problem with Verizon was how upfront they sold it purely as an unlimited agreement, saying nothing about bandwidth limits. Then they change their agreement and not notify us, and then they shut us off with no factual reasoning based on usage, stating we "Must" have been participating in activities that were prohibited.

My feeling was this was an unethical business practice. The cost of the equipment won't be much, but hopefully the end result will be a more realistic agreement.
