Case in point: Owner had a transmission fail, insurance co requested maintenance records. They determined the engine oil wasn't changed till 750 miles past recommended mileage. Result was that they denied ALL coverage. The company did refund the owners payment for the so called coverage and that was it.
If the owner went to court he most likely would have won. The burden is on the warranty company to prove that the cause of damage was bad oil that was changed 750 miles too late. If the damage was not caused by bad oil then the warranty company would lose. They cannot deny simply because of missed maintenance. They have to prove that lack of proper maintenance was the cause of the damage.
