HUD involved in this Cedar Creek RV Park?

I don't think I would want HUD to declare my motorhome a dwelling unless I were living in it.

Also, this case is going to be setting a precedent if it does so.....

HUD pursues anti-LGBT discrimination charges against RV park owner

But would you still take the "second home interest deduction" from the IRS if you were paying interest on it?

I'm not sure I see the issue here. Sure seems to be blatant discrimination to me... at least from what was covered in the news story.

News article certainly is nebulous. What does the rental agreement say, what rights does the park owner retain regarding occupancy.? Why are the park rules not signed.. There must have been some basis for a court ordered eviction..
The article provides no evidence of an underlying discrimination based on sexual preference. ... Which would be wrong...

2nd home interest deduction is an IRS determination, not yet under the purview of HUD, even while unoccupied.

Don't be so sure about that. The IRS doesn't make up the regulations in a vacuum. All IRS regs are based on some Federal Act or Code. So the underlying legislation that defines a "dwelling" for income tax purposes could very well be applicable to other legislation enforced by other federal agencies, such as HUD.

Sounds like trouble makers from the start. They need to move down the road where trailer trash is appreciated. Nothing wrong with Texan RV Park.

IRS Pub 926 -Mortgage Interest: Doesn't define dwelling-Even when HUD provides Mortgage assistance...

Qualified Home
For you to take a home mortgage interest deduction, your debt must be secured by a qualified home. This means your main home or your second home. A home includes a house, condominium, cooperative, mobile home, house trailer, boat, or similar property that has sleeping, cooking, and toilet facilities.

HUD's definition however can be what ever they want it to be...

Second home interest deduction to me is a completely different issue than HUD's authority for discrimination/rental enforcement. Also, I am not renting my motorhome to anyone, so I can't connect the dots there.

There are always two sides to every story.

I know when attorneys and government agencies get involved with disputes, they get elevated to a higher confrontation level and almost impossible to resolve.

I sure hope it gets resolved for both parties best interests.

I personally know a transgender woman that served 20+ years in the Army Guard. She was often called to active duty with the Air Cav as a helicopter pilot. That included 3 combat tours in Iraq & Afghanistan with a few combat related medals.

At that point she was a man.

It is strange to me calling "him" a "her" after knowing them as a local pilot for over 25 years. However, I would be honored to have her parked next to me in ANY CG. She is definitely NOT trailer trash.

That being said, I'm not sure of the legal status for "guests". Perhaps the same laws that apply to hotels might also be applicable to CGs?

^^^ X2 Don.
I could not find enough info in the link to have any idea about either of the parties. I have no issue with the LBGT community and have family members and friends in several of the categories. All fine people. Doesn't mean these two are, but they are not trash by default. I'm actually surprised a post above has survived edit.

I also have experience with bait thieving turtles. I have seen many hanging in trees in various settings. Would not want to see or smell that in a RV park - but I would not spend the time trying to get a hook out of ones lip.

Will be interesting to see how this turns out. Did sound as if the owner was "flaming" them on the net and they caught him. To me that's a big no no. There have been some Instances where teens and others have been pushed over the edge by such things. Sad.

The jury is out on this and the details are sketchy at best in the attached. Always a good idea to hold the executioner until there's a verdict and a full investigation has been completed. 12 Angry Men - great movie - sad commentary.

I think that you are totally correct that no group of people can be canonized or convicted on the basis of social identity. IMHO, people should be judged on the content of character. That being said some will judge character based on their moral values and I suppose that is a personal choice I can't argue with because I don't hold the keys to moral superiority. I just know that it isn't my lot in life to pass final judgment on anyone.

All I care is that my neighbors understand the one golden rule that I try to live by, Do unto others as you would have done to you. Of course, there is that other one that goes with it, Judge not lest you judged.

Seems kind of insane, but in some states acceptance of one or more monthly-billed rents changes the status from "camper" to "tenant."
