Montana LLC

Hello Friends,

My wife and I are looking to buy a class A diesel pusher soon. In talking to a salesman, he mentioned, since we plan to pay cash (for a used one!), that we should look into creating an LLC in Montana, register and title the coach in Montana and we would save the thousands of dollars in sales tax. This sounds fishy! There must be a catch. Do any of you know anything about this? We are all about saving money, but don't want to break any laws!! Thanks for any wisdom you can share.

I had my accountant look into it and he felt it was 'tax fraud' instead of 'tax avoidance'. There are some internet stories about the state of CO going after CO residents who went the MT LLC route.

Additionally the financials did not make sense if you plan on keeping the RV more than 5 years. Insurance and loan interest rates were higher with the LLC version so after 5 years the sales tax savings was eliminated by the higher carrying costs.

Whether it is legit or tax fraud depends on the details. If you license it in Montana but keep the motorhome at your home in Massachusetts or Colorado, you are almost surely guilty of defrauding those states. If you store the motorhome in Montana while you live elsewhere, or live in the motorhome and drive ita round more-or-less fulltime, its perfectly legit.

Most states have tax & tag laws that require that a vehicle kept/used within the state must be titled & tagged there. Details of those laws and how they may apply vary by state. Consult a tax advisor.
