Dale & Mark: Good explanation but in the 3rd paragraph I think you meant 'Montana' rather than 'South Dakota'.

If I may clarify one other comment that Dale made. Tax evasion is criminal but the burden of proof switches when a tax matter is changed to criminal. For all tax situations other than criminal the burden of proof is on the taxpayer. It's rare for any taxing jurisdiction to bring about criminal charges. If you get nailed with having an illegal Montana LLC you will subject to the tax, penalties, and interest but you won't go to jail. The penalties and interest can be quite substantial so that's another issue.

Along the lines of the OP's question, I would be curious if anyone who is full timing with a South Dakota residency has ever had an issue with the SD authorities about their Montana LLC. From many of the prior posts that I have seen I would guess that to date it hasn't been an issue.

No I meant South Dakota. SD is considered by a tax avoidance state by Colorado and other adjoining states.

Just to clarify my original question, we are paying cash (no loan) for our RV and will be full-timing (we have sold our home). We would domicile in SD, not physically reside there.

The only issue I imagine is if we were ever pulled over in SD, would it matter that we have SD drivers license and MT plates? Otherwise, I would not imagine any other issue if we were in any other state.

Looks like you are trying to avoid paying sales tax on the rv. Sales tax in SD is only 3% and you only pay on the difference of your trade and the new unit. License fees for MT and SD are roughly the same. So unless you are spending a bunch of money on the rv, it might not be worth fooling with the LLC
