Hey Mark, at 58 yrs, I don't heal/recover very fast anyways but money aside, as the OP said, waiting might give you some options that may cover things that may not be readily apparent now. Not so much for collecting from the other guy but in settling with your own insurance. I'm no expert and it might not matter.

Glad to hear you are riding. I have the Tour of Cali, and the CO pro tour on my short list to see before we head to Europe and see TDF. Told the DW that we 'need' to go to Europe and partake in the spectacle before we get too old to get up the mountains!

Well, the driver has a TRUCK... do you need one ?!?

I too would recommend a jury in a civil suit.... you are more forgiving than I would be !

Did they ever determine why he hit you ? it looked like he was aiming for you !

personally I give anything on the side of the road a large berth, even a squirrel, much less another human being !

The sad truth is that people often give road kill more room than a person. I would also not be so forgiving.

Just because someone's insurance policy is capped at 100K does not mean their liability stops there. it just means their insurance won't pay it for them and THEY WILL HAVE TO PAY IT.

I would not settle for an amount less than adequate just because someone is under-insured.

Get the settlement, let their insurance pay out the 100K and let them be responsible for the remainder for the rest of their life or yours until it is paid.

Get well soon from a fellow cyclist (OKC).

I try and avoid roads with high speeds and rush hour traffic when possible.

I have a mirror on my drop and I see at least 90% of the cars from behind before they get to me.

I recognize that the furthest right I should be is the right tire mark. Many times the conditions warrant taking the whole lane for a few seconds. (Such as oncoming traffic). We have many road signs in the area telling car drivers and that the cyclist has the right to take the whole lane.

Just trying to stay alive.....
