A law suit will not get your RV repaired, at least not for months or years.

You do have the right to take the vehicle any place you'd like for the repairs, or at the very least have an independent appraisal done. You need some kind of ammunition if you're going to dispute what you're being offered and I've not seen any in what you've posted so far.

Finding additional damage once the repairs are started is not unusual and in the case of significant damage should probably be expected.

In a perfect world your insurance company would send someone qualified to appraise the damage and completely explain that appraisal to you and what you can expect moving forward. Fact is, most insurance companies don't have anyone on staff qualified to do a damage appraisal on an RV.

Not expert but my take.

Your insurance company will fight the guilty party only for what your insurance covers.

If yiu have full coverage then expect full coverage and assume correct to factory spec.

Verify that the warranty clock will stop as it is out of service.

The guilty party must cover all expenses and it is up to you and nobody else to make sure that happens

First advise all interested parties that the expectation is perfection meaning unit will look and feel exactly as it was 10 seconds before impact.

It is a new item and not a classic car so every part is currently available and it is expected that any part needed upto and including a replacement full wall panel can and will be used if needed.

Zero modifications of any sort will be allowed as it is still under warranty and as such any and all repairs must pass muster with the manufacturer which means that per the warranty requirements that usually indicate warranty void if any work performed by non- authorized parties voids warranty...

Next contact manufacturer and consult them to locate a factory authorized service center and state that the factory may be the optimum place due to the nature of the damage.

The guilty party would be responsible for transportation to and from factory...

Do not worry about lawsuit yet...

The guilty party insurance is going to pay the bill and if you have full coverage your insurance would be required if your fault. ..Your insurance should help you get claim filled...Unless both parties are same carrier.

Next work with manufacturer to get warranty clock stopped, this may require special process or in this case since not due to manufacturer problem may be a fee based thing so have them provide the quote for the guilty party.

Next contact rv rental companies to locate the closest thing to what you have now and get a quote to rent one for the time yours is out of service...like renting a car while your wrecked one is fixed...guilty party pays...Been there with rental for a month or so on a car.

Add up the costs...

Wait for it...

Contact where you bought current unit and ask about a trade in of the wrecked one as is for exact one you have.

If that is less cost than repair present as option to interested parties and see where it goes.

Use the rental and repair quality expectations as leverage as they will want you to go away. ..

Ask them if they know what "Bad Faith" is. Sometimes if you win a bad faith claim your award is 3x your damages.

This is based on 40 years of claims handling.

Never liked Public Adjusters, there are good ones and bad ones. But they are some times a necessary evil.

Don't mess around and get a "Good" Lawyer. and to answer the first question, Yes. Went right to the court house and then they handed me a check. Just a waste of time and money as they thought, but they didn't know the lawyer did that one for free. Don't mess around and get a Lawyer! Well worth it in the end.
