The issue are the ones that are unlawfully obtained...or borrowed. They might not be able to question your disability but they can and should question if you are the rightful owner of the placard or at a minimum a passenger in the car that displays the plate.

All a law enforcement officer has to do is check your driver license and the number on the tag, which when displayed by laws as it has to, they can check very easily. No, they cannot ask what the disability is, but they can check to see if you rate the card/plates.

DW found with a little searching that in NY only the person issued the tag is legal to use it in a handicap space. That means if someone else is driving they must drop them at the door and park in a regular space. The person I originally posted this about has her DH drive any time we have seen them. A double insult to the people that need those spaces.

Perhaps the tag number should be in a database for LEOs to use with a photo of the person issued the tag.

Ok folks I can write parking tickets and I do write handicap parking violations, $270 up to $978. There are many types of disabilities and no LEO or other ticket writer can ask what handicap someone might have. Some handicapped people can climb into lifted pickups others can't but you can not ask nor should you judge. Each placard or plate has a number, I can call that in a get a description. If the individual owning the plate or plaque is a 70 year old female and the cars occupants are teens they get a ticket. An LEO can write a much larger ticket and confiscate the plaque. A doctor has made the decision about the disability you don't. There are many different disabilities but everyone can do something.

Some disabled people appear to perfectly healthy only to find they have had a quadruple bypass or are undergoing chemo etc., don't judge. It is none of your business. When people ask me what my handicap is on my bike I say unresolved mental issues, they leave me alone.

Enough violators park in disabled spots, usually, to keep me busy when I go out. I have a choice as to which ticket to write, wether to issue a warning or to void the ticket. It depends upon the situation and the attitude of the violator. If I suspect an invalid use I call a LEO.

I still don't understand how what you drive has to do with it corvette truck lifted or not I have a slightly lifted truck I use for my fithwheel and I suppose I have a rv I can't be handicapped I also. Need 2 canes to walk with and use a scooter to get around and a lot of people wouldn't get out of the house to go to the store without the permits hanging or plate I have been told by people when pulling into handi spots you sure don't look handicap when I get out and they see me try to walk I sure hope they feel stupid you can't judge a person buy how they look and you sure as he'll can't by what they drive..

No your interpretation is not correct. As long as the person who holds the tags is/was in the car, being transported, the driver can park in the disabled spot and wait. Every person with placard or plates has an ID to carry with them. An example is the multiple person handicapped van. The driver usually is not handicapped but he has a placard or plate and he can use a disabled spot as long as he is transporting a disabled person.

Wow! I saw a girl jump out of a Cobra, car, over the door. Right she had handicap tags. Or today a whale in a Wal-Mart power chair with a Pomeranian on her lap with a service dog jacket. Brings tears to your eyes.

I stand corrected. I looked up the info myself and found that you are correct. In the case of the van I totally understand since room is needed to unload. I still do not understand why you would not drop most handicapped people right at the door and park in a regular spot.

Could be several reason for not dropping off handicapped passenger at the front door. The local super market where we shop, has the entire front marked in red, and is desiganted as a fire lane. Also stopping at the front door in front of a business often backs up traffic, both pedestrian and vehicle. (I am reminded of our local Costco) . Use the handicapped parking spaces for discharging and loading passengers is a much better idea. Many times it takes much longer to get handicapped persons in and out of a vehicle.

Lots of us disabled have wheelchairs or power scooters, or even cannot walk far enough to get to the stores scooters.

These appliances must be unloaded and sometimes takes a lot of room to do so. In front of the store, usually a fire lane, is not the place to do it.

I personally carry my own power scooter as I do not want to depend on the ones in the stores. If none are available, which I have seen, I cannot shop.

I agree

My Dad had 60% of his heart dead and cancer but to look at him he looked pretty strong and he was, he just couldn't breath if stressed.
His line was if anyone told him he didn't look handicap was that they didn't look like a doctor
He never abused it and keep on working up to a week or two before passing. He was my Best friend that i miss daily!

There appears to be two opinions,one that only the driver can lawfully use the card, or card owner must leave the car and two if the owner is only a passenger and doesn't leave the vehicle it is a violation.
Seems to me that as long as the card recipient is in the car it is okay. Can anyone site chapter and verse?
