HOA RV Park Restrooms
We own a lot in Georgia. We have a few folks...very few that stay year round and most stay Apr thru Oct. The practice has been to keep the bathrooms open thru the off season for those few that want to come up in the winter for a day or two. By closing during off season we could save $2000 to $2500. We have been told by the board that the Law requires we keep open. I have a hard time believing this and the $ could be used elsewhere. If anyone knows of such a law be share. Txs

I'm guessing it's not "the law" but instead something in the covenants requiring the facility to remain open all year.

It may also be in the specifications that were applied to get the development permit.

Nothing in Convenants , I'm curious regarding the Developer permit. Have no idea how this would be enforced. We recently adopted large lp tanks so those that wanted to visit for weekends would have plenty of lp. The Directors here are appointed for life in the bylaws however convenants state we should have annual election. Difficult seperating fact from fiction. Anyway back to restrooms doesn't seem wise to heat and maintain during off season.

Could be a county ordnance or a vague state statue. Most of these are on line if you wanted to spend some time reading boring legislation. Also the developer could have told the board of directors these need to stay open for owners/guests year round and that had morphed into law.
There is a lot of goodness in HOA's and there is also some real personalities that can make them a nightmare.

There may actually be a chapter in the health code..You said HOA park..HOA here usually means Home Owners Assn. However I do not see how that would apply to an RV park.
Some facilities that are open to the public.. ARE required to have a restroom for public use.. OTHERS,, are not.. and I do not know which is which. But check with your county department of health cause that is where the law, if any, generally applies.
Where in GA are you? I am in Townsend.

Just thinking.... If you find you are required to have restrooms there during this time, why not close the building, but supply a port-potty.

Your RV park is likely governed by the same laws as any campground. I have zero experience in Texas but I know there are laws both here in South Carolina and in our old home state of Wisconsin still on the books, some of which make little sense to me. For example, in both the "campground" is required to give 24/7 access to an "emergency" phone, ie: one that can be used to call 911. So both our old seasonal park in Wisconsin and our ownership RV park here in South Carolina have to bear the expense of a land line that's accessible (meaning vulnerable to vandals and pranksters) at all hours of the day, regardless of office hours.
I have no trouble believing that public rest room facilities would be required by those same set of campground/RV park statutes.

It's probably an ownership RV Resort, which would be governed by an HOA. Both of the resorts we own lots at have an HOA.

Check with the local leo office and cell carriers for emergency services.
In the old days it was called "ring down" meaning just picking up the handset resulted in the device ringing a specific number...before 911...
Call boxes along the highway are current versions with cell phones.
You may be able to work with local government and phone providers to get some sort of call box mounted in the correct spot to meet code and maybe less cost.
Check also university if one nearby as many are installing panic boxes for students out at night.

We are in Union County. A similar park next door doesn't believe such a law exists. We have a list of things that will require the attention of a lawyer. Appreciate all the input.

Thanks... That explains it..Did not think of those because Well The places I have looked at like that the park makes the rules, not the HOA.. (I park just downhill from one on occasion and have coffee with some of the folks who live there).
I would say the only option is "Closed for winter" gate at the park entrance and nobody comes in.
Might also save by putting a single "Winterized" Restroom/shower facility..One toilet,Shower, Wash basin Lock on door,Baby table.. UNISEX
