Nice that you cite criminal laws in several states, which of course vary from state to state.

You rear end me, Without a towed braking system. I do not care what state we are in, I call Dewy, Cheatem & Howe (Thanks 3-stooges for a great law firm name) and use words like "Reckless Endangerment"

The 100 buck or so fine the criminal law would slap on you is nothing compared to what D, C & H will ask for.. I mean the fine has two zeros.. I'm going to ask for Two COMMAS, minimum.

That is the law you should worry about and it does not vary from place to place like criminal laws do.. It is common law. Though some folks may value their lives less than I do mine. (Or more)

I use D-Brake's Professional Tow Brake when ever I tow. Its a drop in system that uses a reliable electric actuator. Its great for when you want to tow more than one car.

Should you choose NOT to put a braking system on your toad (and I'll cast another vote for US Gear), please post a photo of your rig. I want to be able to see you coming and stay out from in front of you.

Fact #1 - Michigan and most other states do NOT have a toad brake law.

Fact #2 - It is GOOD to use one from a safety standpoint and as an assist.

Fact #3 - You can be sued for rearending someone WITH or without a towed
braking system.....it's called "failure to have your vehicle under
control". Don't let the scare tactics sway you.
