As has been stated, very, very sorry for the ultimate bad luck. I always think when something like this happens, "if I'd only caught one more stop light, some place back, I wouldn't have been in this situation". Oh well, it's done, and, you're on the way to getting things all better. Now, off topic just a little bit, may I ask, where did this happen?

The wife and I have traveled through Utah many, many times for vacations, on the way to the Easter Jeep Safari in Moab, up to Yellow Stone, and much more.
And, we've gotten to know many stretches of the Utah highways, sort of.

And, to us, based on what's visible in the pictures, mountains, no signs of indication of area or town, openness etc., that looks like it may be close to Beaver UT. But, this is just a guess.

Fire Up, this all happened at the public rest stop/truck stop in Scipio. Afterwards, we drove 2 more hours to Beaver and stayed at the KOA there for 1 night. We continued on to Page (wahweep campgrounds) and stayed a week. But we had to cancel our trip to Monument Valley and Canyon de Chelly to get the Jeep into the collision center in Phoenix.

I am working directly with the trucker's insurance company. They have been cooperative and want to put a check in my hands based upon the estimated repairs in order for me to sign the release. They promise to pay any additional charges, but I am not the trusting type.

So, I have opted to pay the whole bill and will settle once the Jeep is repaired to my satisfaction. Its a process, but it is moving forward.

In conclusion...

Finally settled with the trucker's insurance company... 3 months after the incident.
Initially, the insurance co wanted to get me to sign a release ASAP by giving me a check and promises to pay for additional damages and car rental.

I was unhappy with that proposal as my entire spring trip had to be cancelled and I was getting the Jeep repaired in a city that was not my home. Repairs took nearly 5 weeks and $5000. Rental car was another $1300.

I didn't hire a lawyer, but did a bunch of online research. I learned about "Diminished Value" and told the ins co that I wanted repairs, rental expenses and $4500 in diminished value. They did their own diminished value estimate and proposed $3400.

I accepted and signed the release. They sent a check and the process was complete.

The hard part was just not knowing. Legal action is a big, expensive unknown and few law firms specialize in property damage only. (they all want the big personal injury cases). I always felt the ins co could always give me a take it or leave it offer and I would have little recourse except to turn it over to my own insurance.
