The VA would solve all it's problems if it went back to its original mission. That mission was to treat veterans who were injured on active duty or ADT if guard/reserve. When congress, in its infinite wisdom to get more votes, decided all vets should have coverage, it was not properly funded or staffed. When we all signed on the dotted line, no where did it say, "you are hereby granted medical care for life."

Interesting discussion this morning on Constitutional Law.. That law may not be binding under the Constitution. The Constitution gives the President the power to nominate various officers including members of his cabinet and the Senate the right to Advice and Consent. The Law on years of retirement is Advice, the President still has the power to nominate and the Senate can take that advice in consideration when determining consent.

Here's the fallacy of the law as I see it. Congress did not forbid retired officers from becoming SecDef, it only required a 7 year delay. This somehow ensures civilian control. Can anyone explain what magic is supposed to occur between the three years since Mattis' retirement and the 7 demanded by law? I became a civilian the day I retired, as did Mattis. Like most things that come out of DC, this is BS.

As I understand military rules, retired officers may be recalled to AD at ANY time, if they are physically able to serve. Not so for enlisted retired, there is a time limit, which I have forgotten since I've been retired for 24 yrs.
Perhaps this is one reason congress is involved.

Isn't it where you (Military retirees) are under 30 years, your in the reserve. I may have retired with 22 years, but I was in the fleet reserve till my 30th year. Before that, my pay wasn't a retirement pay, it was called a retainer pay. Are all enlisted under this rule?

As I understand it...the oath I took has no time limit...NO escape clause. Why Uncle Sam would want a 67 year old back is unknown to me but I'd go...willingly...law or no law.

I am retired navy 1959 -1980- I have always said that the Sec. of Defense should be a military person that has earned the right not a politician who got it for paid back favors. Civilians are what screwed us up in Nam, and other places too, they play the political game instead of plying to win the conflict whatever / wherever it may be.

One to think about... Not one US Citizen (outside of a jury) has yet to vote on TRUMP,, Not one (You voted for people who are supposed to do that) the election is not till next week.
Lots of noise which suggests Trump may not do as well next week as expected... But remember folks the election for President is not till next week.. No matter what the news says about the one last month.
So, do not count your appointees till the man appointing them is elected please.

Well after Mr Trump is sworn into office on Jan 20, 2017, he may decide to only be a one term President. He might decide to nominate General Mathis to run in the next Presidential election since he already has campaign slogan.
