Yeah, same here. I had my case all the way up to the BVA a few years ago, with citations from the BVA, but dealing with the VA again made me so depressed that I had to give up.

Thankyou DAV. Don't give up anyone! Its well worth the time to keep trying. I found out last week my disability percentage was increased do to a worsening condition!

Take Control of your VA Claim

It seems like most of you here have gone through the system at least once so what words of wisdom would you have for a 26 year old USMC/Afghan war Vet who’s doing his initial filing with the VA later this week.
I’ve been pushing my son to file a claim for the past 3 years and up till now he didn’t feel he was injured enough to file.
Among other things he’s being treated for PTSD, has back issues (went in 6’2” came out 6’1 1/2”).
Thanks for any advice you may have.

I made copies of all my medical records before leaving military service. Did not have to wait for the VA to get my records from military as I had all the records available when I filed. Also claim everything you were treated for during your service. Later in life when it comes back to bite you there will be a record for the medical problem you were treated for in the service. I dislocated a knee and was treated in the Military. Got 0% rating for my knee but now it needs replaced so I can make a upgraded claim when I get it repaired.

Its not uncommon for VA to re-evaluate veteran after corrective joint replacement surgery that was rated for SC disability. i.e. your getting 60% for one total leg due to service injury. You have joint replacement knee/hip. After recovery period VA has you re-valed and reduces your leg rating. VA rates you on your current condition, not on what it use to be. Now due to age (assume your a senior) you may dodge a bullet on total condition. But if your a young or even middle age vet, I've seen it happen. To the point that vet refuses procedure. They can't do anything about that..yet. Check it out.

That is so true. In my case the disability rating changed from my right hip replacement to my left hip replacement. Right hip was done twice. It was based on my pain level. I am being treated for my left hip pain and forgot to complain about my continuous right hip pain so right hip pain was lowered. WTH!!!! Still ended up with a 90% rating. Seems impossible to get 100% for me.

Coop, Im sure you know this, and your NOT rated IU ?
" Individual Unemployability is a part of VA's disability compensation program that allows VA to pay certain Veterans disability compensation at the 100% rate, even though VA has not rated their service-connected disabilities at the total level".

Yes my disability rating has changed several times, always with a increase, and every time time the VA has encouraged me to apply for IU.

It was my understanding that thats one you don't request. But is awarded by by VA eval board based on their findings. At least it worked that way here.

Every time my rating changed the VA would mail me the paperwork to apply for IU that is what I meant When I said the VA encouraged me to apply for IU.

When I initially signed up with the VA the county service officer told me to put everything that had ever happened to me on the application. Received partial benefits for several years. Then came three new presumptives. The VA reopened my claim and a couple of years later I was granted 100%. A six figure back pay was deposited in my checking account.Enough to buy a new MH.
