Montana LLC

I searched the thread but was unable to find an answer. I have a 2005 Windsor 40 PDQ that was delivered out of state and registered in Montana. I had back surgery in Jan so I will not be traveling much for a number of months. I'm trying to get the RV registered in Calif but when I took the paperwork to AAA, they said because the vehicle was coming from out of state that I need a smog cert. I thought because of the weight that smog cert was exempt. Had anyone else had this issue?

Is your GVWR rating over 14,000? I would think it is and if so you should not be required to do a smog inspection. I ask that as I live in Calif and I know the brilliant minds in Sacramento passed a law requiring diesel vehicles 1998 and up to be inspected but vehicles over the maximum 14,000 GVWR are for now still exempt from the program.

Do a search on "California Diesel Inspection Law" and you'll get places you can search regarding this dumb law or try the one below.

Found out the people at AAA didn't know much about registering a vehicle over 10k lbs. That is their limit on registering vehicles. Per Calif law, any diesel RV is exempt, also if the diesel vehicle is over 14k lbs.
Two years age I tried going through a registration service and they said their sources at DMV said that I had to pay $18k taxes to register in Calif. A couple months ago, AAA said that I can register without paying taxes. I have an appointment on Tues (3-19) with DMV on another issue so I will be asking questions then. I will post what I find out.

I also live in CA and have purchased many vehicles while out of state. As with them all, including my previous and current DP, I needed a CA DMV VIN verification form from there web site filled out by a police officer, which is real simple. They always have waited for the smog inspection until i got home. I called the Sacramento DMV office 800-777-0133 and got the total due and a list of requested forms, mailed it all in and they sent the plates.

While there may not be any annual smog test, could it be that on first registering a vehicle in CA, all vehicles have to have an initial test done.

Yes 8.75 sales tax along with title and registration fees.

Why would you want to move the regestration to Cal. Keep it in Montana and avoid the sales tax. There are many Montana Lawyers that will set up an LLC for 200 bucks and do all the work for 125 a year fee. My plates cost about $42 a year in Montana and no sales tax.

My toad has Calif plates. Every time Calif has financial problems (which is frequent), CHP is extra vigilante looking for the mismatch plates.

I just moved to Montana from CA and my DMV fee for my 2007 Diplomat was $235. CA was $725 last year.

Just came back from my DMV appt. My forms were not filled out correctly so they wouldn't process it. My coach is registered to my LLC and financed through Suntrust. I can not transfer to my name because it's financed still. They will transfer to the LLC though. I asked if I had to pay the 9% sales tax and they said no because it was purchased in 2005 and out of state since then. I have another appt. on Thur to submit the paperwork again. I will update more after then.
