Licensing your RV into a Montana LLC

Has anyone on this forum themselves used the following law firm to create an LLC for the purpose of licensing you RV:

Many MANY post on the use of the Montana LLC and how some states are changing there tax laws to prevent it .
Unless you plan to full time and move your coach frequently, out of California for the majority of the year , you'll run afoul of CA. tax laws .

I purchased my coach in Montana , and the salesman tried to set me up with an LLC at the Bennett firm ( Bennett sponsored the LLC tax law in Montana ) even though the LLC and Montana registration is useless to a Canadian; we can't cross the border into Canada driving a US registered vehicle.

BTW: I do know a former CA resident who has used Bennett for his LLC and currently full times the majority of the year out of state. He is not a member here in the forums but I can contact him if you don't get all the info you need here.

One of our clients used Bennett to set up his Montana LLC. When he got nailed by the NYS Taxation and Finance folks he was told by the Bennett firm that they are not licensed in NY and he was on his own. It was quite costly for him.

Plug Montana LLC into the powered by Google search bar at the top of the forum and you'll get page after page of discussions pro and con on this recurring issue. There are some in the discussions that have used the LLC route.

One of the suggestions I read is of the CPA that was going to establish a Montana Business Trust and have the trust buy the motorhome. Then he was going to rent from the trust. That way he could say the coach with Montana plates in his yard was owned by Montana RV leasing company and he was just renting it. Sounds interesting. I'm not in the market for a new coach, but wonder if it works better than the LLC.

first if passed only affects new not used.


1 percent surtax on new vehicles and RVs with manufacturers’ suggested retail prices of more than $150,000. The tax would drop to 0.9 percent when vehicles are 1 year old, to 0.8 percent if they are 2 years old.

and that's 7-8 times lessthan most states

Residents of WA did exactly that, cost them over $25,000 in fees and fines. I have a redacted copy of the court papers but it's over 25 MG so I can't post it.

one point to be mindful of is YOU are not personally responsible for it.

YOU don't own it a corp or LLC does.

Understand, if you are setting up an LLC to avoid paying taxes in your home state of California, your state considers you a tax cheat. There is no sugar-coating this. And when they see Montana plates sitting in their state they're going after their residents for back taxes and penalties.

And it's not just California.

Personally, I've never figured out why people who can spend $400k or more on an RV would want to nickel and dime their state for registration fees and taxes, especially since they fund infrastructure in that state.

If states would just put a cap on taxes it would stop a lot of those registrations.

Like $10,000 max cap

I asked because a close relative is trading for a new Newell. Sales tax is about 80 grand. Seems like a lot to give up without looking for an alternative.
