I bought my coach and a Jeep. Registered them both with action services in Montana. I purposely bought a ten year old coach to qualify for the permanent registration option. Both vehicles have Montana tags. I pay an annual Corp maint fee to action. Very happy. [moderator edit]

Anyone who does the Montana LLC and has no legit business purpose and travels with that RV to their home state has not "gotten away" with anything. They just haven't been challenged yet.
Fines are pretty high here in Washington state. Cali is worse. I'm as tight with a dime as anyone here and won't even consider that tax dodge.

we had a Montana LLC until the Illinois Department of Revenue knocked on the door. I think a neighbor reported me. They ask "has the motorhome ever been in Montana" It had not. I did not fight it and they had me pay the taxes that I had avoided. No penalties.

I think he means a LLC that is a real business.

Sounds like you got lucky, though the fact your RV had never been to Montana is irrelevant. It's that you had it sitting at your house in Illinois that was the issue. Odd though, i've never heard of no interest and penalties unless by a court judgement.

There are lots of LLCs that do nothing more than own property and for no other reason than the tax and liability benefits as well as anominaty they afford to individuals.

In my state (and many others), even if the vehicle was used for what you call a "real business" it can only be garaged instate for a short period of time before being legally required to register and be taxed.

Without reading through all the replies - a Montana LLC is IMHO simple - Read - Learn - Understand - Educate yourself - Talk to a Lawyer.

Find out if it works for you, then YOU decide.

If it is too complicated then..............maybe it's just not for You.

It has worked and Does work for Many.

If cheap is what you seek then likely that is what you will get.

Best of Luck,

Not sure just re-reading the posts already on display in the forum is going to further prove or disprove any of the opinions made in this thread.

It's pretty clear that there are individuals that have pursued the Montana LLC with success. Given just over 1 million people live in Montana and the amount of Montana plates I see touring the country, there are lots of them. A handful of those that did not do their homework were made examples of.

The majority say, "Do Your Homework"... As with any financial decisions, it is prudent hire a professional to help you, not base your decision on opinions from the peanut gallery...

Never considered it...

I never considered it. I figured if I was going to spend the dollars on a coach then I needed to spend the dollars to register it in the state that I live.

I don't see any RV's around here with Montana plates on them. You could get by with it for a while I guess but the registration process here for tags is tied to your personal property tax. When you get your tag for the vehicle the tax is due. I would assume that something as big as my RV with a set of Montana tags on it would eventually get either reported by someone in the area or if I was in a wreck or license checkpoint that NC drivers license and Montana plates would not jive. I'm 60 years old and don't need or deserve the aggravation.

Everyone we know who has been challenged by their "home" state over a MT registration has either lost or settled the cases. The choice requires a careful review of your particular situation. Most would agree that if you're going to license in MT and garage and use your RV out of another state you're probably looking for trouble.

Go to a high end RV resort and you will see that most of the Newells, and Prevost conversions have Montana plates, as the tax burden on owning one of those is huge.

If you assume a $1.7 million sales price , 8.5% sales tax, and an effective income tax rate of 15%( to earn the $1.7 million to buy the coach) then the amount of tax paid for the luxury of buying the coach is around $400K . These buyers have the money to either pay the tax or fight the tax if they're caught, and many decide to take the gamble.

If you can't afford to pay the piper when caught, it might be best not to mess with the tax collectors
