To me, the article didn't really get specific on the EPA mandated derate, so I don't exactly know how the manufacturers got to 5 mph. The devil is in the details.
The 50mph is in the "new" 2026 (lol) rules.
Good article though, hope you diesel guys get some "official" relief now instead of having to rely on the aftermarket "fix".

I sure would like to see cummins release a software update as a "SAFETY RECALL"
'cause going 5 mph down the highway is in fact a safety problem.

Sad that the NHTSA did not see it as a safety issue. 1.5 years later since many of us filed complaints and nothing. However I have received 3 or 4 recalls on my 21 that are basically nothing, but a safety recalls have been issued.

I got derated to 5 mpg when my Throttle Position Sensor went bad on I 95 North in South Carolina. It was 10 am on a Friday. It was terrible and dangerous. I finally limped off to a Truck Stop. I really was worried about getting rear ended. I drove 2 miles on I 95 to the exit at 5 mpg on the brim. 2 miles of driving over a bunch of garbage on the brim. All I needed was a flat next.

The NHTSA does not see that as a safety issue, but no fuse on a power seat is. I have not moved my power seat once it was set since new, but it has a recall.

It is far too early to expect a new software update. The consequences for screwing it up are not nice. It takes time to do these things properly, especially in embedded software like that which must run in restricted environments.

Should be a software update to fix that. I’d put my money on it was an easy way to guarantee a tow and mx charges.

Nitrogen Oxide (NO2) causes acid rain, it is not harmless. Natural substance, sure, but so is radon, and not good for your health in high doses.

What I don’t understand is we have a giant debacle with the DEF heads. If the EPA says it didn’t set the 5 mph, why not make the change next month. This is a safety issue. Why 2027?
