Scary stuff. I sure wish there were more details in the report though. It sounds like the driver could have been at least partially responsible. No mention of pressure was made and I sure don't know what to make of the comment about the driver getting out of the driver's seat at highway speeds!
In any case, I'm glad I'm ridding on Micheliens.

I don't know the merits of this case but, I do know that these awards are not paid for by the Company. You and I pay for these type of awards in higher prices for insurance premiums and consumer products.
Just my opinion.

I am sorry that people got injured in a bad crash, but I agree, What was he doing leaving his seat while in motion, and if he was travelling 75mph, that's asking for trouble.

And, 75 MPH towing without a supplemental braking system. Wow! Much more daring then I would ever care to be.

I actually served on a jury regarding tire seperation 2 years ago. We did not award the family anything, the evidence did not point to Goodyear, it pointed to the fact she was not wearing her seatbelt, and driving too fast.
So the facts need to be presented, that jury must have had the evidence. That is my guess anyway

It's not unusual for a jury to ignore legalities or even the facts and make awards based on deep pockets. I don't know if that's the case here, or if Goodyear was obfuscating the issue with those throw-away remarks about the driver leaving the seat, etc. Trying to decide right and wrong based on a news report (and a skimpy one at that) is an exericse in futility.

Howdy y'all,
I'm like Gary RV Roamer. There's not enuff facts to make a sound judgement
but it the guy was doing 75mph, left his seat at that speed and didn't have any brakes on his toad...HE'S AN IDIOT!!! Even though an RV or bus will run 75mph thatz way too fast for GOOD CONTROL OF THE VEHICLE !! Just a good cross wind can knock a 45 footer into the next lane..

Is just one of a full page of search results for "Goodyear G159 tire failure". The way the article is written, the driver was negligent in several areas. This award will probably be reversed to some extent. Remember the Mc D's hot coffee award? It was overturned by a higher court later.
