Hmmm.. Having dealt with IFTA with commercial rigs... one Indicator notating a private vehicle (RV vs "for hire" bus/transportation) would be a sign near entry door, saying "private coach" or similar..
I had an IL weigh master/DOT chase me down after bypassing an open scale on I-80.
After producing registration/licensing doc's proving that it is indeed a private RV, He stated that a "not for hire/Private Coach sign near the entry door would be helpful.
He then admitted that as I had bypassed the scale He noted there was not a rear ladder on our coach (ladder deleted) so assumed that it was a tour/commercial use rig.

I wonder how many of those guys exsist in IL. Of course if one gets ticketed, it doesn't matter how many exsist.

I agree about the "revenue officer" moniker. In Virginia Beach, one section of highway about 5 miles long never has less than three and sometimes as many as 8 or 9 state troopers issuing tickets. It is close to their office and they are too lazy to patroll other sections of the interstate system.

Fl may not care about the IL 'fuel tax' issue but COULD be interested in MH registration issues....MT LLC vs FL Tags
Especially IF MT LLC was only done to avoid FL taxes ----MH actually garaged/located in FL vs Full Time
Details.....that is what gets 'em

I was on my way to work an outage at a nuke plant when I car started tailgating me with his brights on then turned on the bubble lights.
Since I just passed on the side of the road a car with Illinois State Police markings, I assumed he was a state trooper. However, I tapped my breaks indicating that I saw him but proceeded to the next exit and pulled into a well lite place that might have security cameras.
He asked me why I did not stop. I asked if there was an emergency. He said no. I said that there are signs posted saying 'emergency stopping only' and as a 'public safety officer' he should be able to tell me how many cops and other people get killed each year by drunks hitting their cars stopped along the road.
After establishing that he pulled me over on a pretext, he asked if he could search my trunk. I asked if I see his federal income taxes for the last 5 years. Why he asked? It is my civic duty to catch tax cheats and I will get a reward.
While the trooper was considering this, I pointed to the hotel and said I have a reservation. I have to be at the nuke plant in the morning. So when you get a warrant, you will now where I am. I parted with an offer to come to the post and teach safety and the US Constitution.
While working in that town, I noticed that police routinely find cash and drugs after 'routine' traffic stops' and confiscate same. Good for them.
One of my favorite gripes is tax cheats. They are surprised when they avoid taxes using a pretext and then a pretext is used to hammer them for revenue.
It is my honor to pay taxes in three states because I have property in three states. Maybe I could save on taxes if I established an LLC. In that case it commercial and not personal property.
The point is you have to follow the rules wherever your at. If you are full time traveling in an RV it can be confusing but that does not change your responsibility. My drivers license, MH, toad, boat and lot to park the MH are in the same state. Not a state know for being tax dodge. The other two state have requirements but is easy to show that I am just visiting family for a few weeks.

Not sure how your state works, but in NC you have to have a state inspection within 3 months of registration. Your insurance, registration and state inspection are all electronically tied together. If you hapen to be in California, stop whatever you are doing and drive 3000 miles back to get your annual inspection. It is not necessarily a tax dodge.

Humm, Full-time Rv'ers (no stix N brix) often have a MT LLC and drivers license from TX, FL, SD, or other favorable state. I've never read of a full-timer encountering this scenario.

if there are truly 8 or 9 troopers on 5 miles of road actively issuing citations, it sounds like they found a good spot. smart hunters go where the game is

Since it's registered by a LLC not a individual it's not exempt from IFTA.
|
That's were they went wrong, because ownership by an LLC does NOT inherently make the usage commercial. That is a well-established legal principle. Note the the definition does not say OWNED by an individual - merely that it is USED by an individual. But that distinction provides a lot of fodder for the lawyers to debate (at great length and high expense).

Agree, completely^^.
The Illinois statute clearly uses the term, "used," in the description of an RV. The ploy by the state tax officer is that, once cited, the owner of the MH will have to prove he is a "user" in court which entails travel back to Illinois and the expense of a lawyer. He, and the state, are betting that the owner will take the path of least resistance and simply pay the fine.
I have no knowledge of the Montana LLC set up, other than its use as a tax dodge. Can someone with the information clarify as to how the MH is identified in the LLC and how the MH can be documented, through the LLC paperwork, as being used by a private individual and not commercially?

Moral of the story. Dont buy a tag axle and register it through an LLC then drive through the most corrupt state in the union.

Illinois may have its "charm" but I'd put Oklahoma and Montana at the top of the list of most corrupt states - mostly all tied to mineral extraction.
I lived in one and worked in the other so have direct experience.
