Credit card transaction fees
Colorado is one if the few states that bans merchants from charging a transaction fee for using a credit card. Sellers can give a discount for cash as long as it is given to anyone and is well documented.
I will likely be buying a tow dolly in the near future and am considering one made and sold in Colorado. The seller states that there is a 3% charge for using a CC and encourages using cash or check. They do offer free delivery, which is great. Overall the fee is small, about $60 or so. I’m torn on whether or not to bring up the fee as an issue.
Have others come across this? If so, what have you done?

I would negotiate with the seller and if you can agree on a total price you are willing to pay, then I would execute the transaction. I would not involve the government in that transaction, but you might express your displeasure with certain charges especially if they are unnecessary or illegal.
It's all just a negotiation. The "free delivery" is actually just included in the price...and probably about the same or less than the imaginary credit card fee they want to charge.

No, because sellers can’t charge a tax not imposed by the state or other government entity. And there will be sales tax charges since I am in Colorado :(

You’re right and I have considered that. I may ask them to take off a reasonable amount if I go and pick it up at their factory.

Any business that accepts credit cards is paying a percentage to the credit card company for the convenience of that sale to the customer.
Yumpin Yemeni! If you pay cash or check the seller does not have to pay a credit card company 3% to 6% on the sale. It is NOT a government tax! It is the cost of doing business with a credit card company.
A good business that does not have to pay for a credit card transaction should pass that savings onto the customer. I did when asked when I had a computer store. If I was NOT asked the difference was more profit on the sale.

So the merchant is in violation of a Colorado law? If that's the case then maybe it's time for a good old fashion shack down or the local Attorney General might get an anonymous phone call.

Why should the merchant have to pay for you using a credit card? Was probably working on a slim profit margin in the first place....or would you rather be overcharged in the first place....

It is the choice of any merchant to accept credit cards or not. Some states allow that decision to cost the consumer extra. Other states make the merchant absorb the cost as part of doing business.

One gas chain in our area/state is permitted to charge more for using a CC. 10 cents a gallon is a bit much. A gas chain that sells as much as they do is under their cash price by a couple pennies. It may be up to the station Mang. what he charges.
