Montana LLC thoughts or experience....
Does anyone know if Montana LLC is worth exploring?

If you are a full-timer, it probably makes sense. If you have an existing domicile in another state--you are IMHO, attempting to avoid taxes thru deception. Accordingly, you should be subject to any and all the fines and penalties afforded under the law--choose wisely grasshopper......

The courts have already ruled that tax avoidance in not illegal, only tax evasion is illegal. A Montana LLC is a legal entity. The LLC can purchase an RV and register it in MT without paying any sales tax and without breaking any laws. I looked into it but found out that the financing would be at corporate rates and the insurance would be at commercial rates so I just bit the bullet and registered my RV in So Dakota and paid the sales tax.

There is also a new twist added to the Montana LLC that their state legislature threw into the mix. If your unit has an MSRP of more than $300,000 there is now an annual fee of $825 that runs for ten years. That negates a good chunk of any tax benefit that the Montana LLC may generate.

I know of none that have prosecuted for tax evasion, but many have gone after the owners of the LLC's for taxes, penalties and interest. Tax evasion is difficult to prove because the state has to prove intent. That is not an easy thing to prove. However, that being said, if they do come after you for criminal tax evasion you will still have to bear the cost of defending yourself.
If you are not a full timer and you do not comply with your state's registration, residency, and sales tax laws you will be liable for the tax and all additional charges which can literally double sales and us tax. Some states, such as NY, have the law structured so that if you own an out of state LLC or corporation and you operate that vehicle at all in NY then you are subject to the sales and use tax laws.
Generally the states that are the most aggressive in pursuing sales tax violations are those that are high tax states like New York, Massachusetts, California, and others. One of my clients got caught with his Montana LLC and the final cost was way more than the sales tax he saved.
