Police Officers enforce laws, they do not make them nor do they determine guilt or punishment and it is up to you to know the law. If the officer made up a law enter a complaint with his department, if not pay your fine and/or do the time.

It appears in this case you are wrong!
The cop stated trucks over 5000 lbs. it didn't say that on the sign.
He wrote the amount of the fine on the ticket.
If he thought the OP was innocent then he would not have given him the ticket.

Orig. post: "I was pulled over and given a ticket for going down a road that is posted "NO TRUCKS" I drive a F250 single rear wheel. This is bull he told me that that sign means over 5,000 lb and my truck is over that"
What part of "NO TRUCKS" is hard to understand?
Some jurisdictions have the amount of fine on ticket so you can plead guilty and mail it in w/o going to court, that's your option, you still have the right to plead your case to a judge and/or jury if you think you innocent

I find it hard to believe that those signs were meant to be "any" or "all" trucks, but would be willing to bet that the original intent behind these "No truck" signs was to keep heavy, commercial trucks from driving on these roads.
Just my view. I've never heard of anyone in my state getting pulled over in a small truck in this manner.

Losing more and more freedom everyday, it seems. Laws used to be to the letter, if evidence wasn't there , no conviction, now we have to decide intent. How about the law being crystal clear with no interpretation needed? Seems lawmakers make new laws to justify their jobs. City ordinances drive me nuts, in my town, they come up with new ordinances to violations that already have ordinances to address them, but they feel they can't enforce fast enough so they pass a new ordinance.

Talked to the PA State Police that say I am legal with my truck. Checked in NC and weighted tags are not commercial tags Permitted tags are. Then called the DA he at this time has not got the ticket yet but will look into it. But did tell me that on the day of the hearing the Judge would probley drop the charges. Told him it was a 8 hour drive and was told I have to appear to have it dropped.

Any judge with half a brain should toss this out, along with the person who wrote it. It's a stupid ticket, IMO.
Good to hear that someone's thinking this through on your side of the law.

Did the DA reiterate the need to appear to have the possibility of dismissial? If so, personally, I would take the drive and be there to fight it.
Good luck.

Ouch, hope it all works out to your favor. Also hope they don't charge you the court cost for their officers mistake.

Not to mention the possible increase in insurance, which is worse over time I'm sure.

It will be interesting to see if they actually go ahead and toss it (by holding the hearing) if the ticket writer isn't present during the FIRST hearing,
or if they wait the requisite THREE appearances to see if you are serious about contesting it before on the third hearing, the ticket writer shows up or not, the judge finally LOOKS at the ticket and tosses it.
I agree, the DA should be able to look at the ticket, and toss it, all without you having to drive the 8 hours to point out how stupid the ticket writer was.
I intentionally used the term "ticket writer" because I don't think that the idiot who wrote that ticket should be elevated to the title of Officer.
It remains to be seen whether PA is interested in correcting an obvious wrong, or if it REALLY IS all about screwing out of state drivers in a $$$$$ grab.
